About 2:00pm on Thursday 8th January 2026, police attached to Barrier Highway Patrol observed a male riding an e-scooter travelling on Iodide Street in Broken Hill.
In New South Wales, e-scooters are prohibited from use on public roads and footpaths and are classified as motorcycles.
Police established the rider was disqualified from obtaining a driver’s licence until mid-2027 and was also not wearing a helmet.
Police subjected the rider to a breath test which returned a negative result for alcohol, however a roadside oral fluid drug test returned a positive result to methamphetamines.
Police obtained a sample of the rider’s oral fluid for later analysis.
As a result of the positive drug test, police directed the rider not to drive/ride motor vehicles for a period of 24 hours.
The rider was permitted to walk his e-scooter home but was warned that it could only be used on private property.
Police issued the rider with a Field Court Attendance Notice for a number of traffic related offences.
About 8:30am on Friday 9th January 2026, police observed the same male riding the same e-scooter eastbound on Williams Street in Broken Hill.
Not only was the rider was still not wearing a helmet but was riding a motor vehicle within 24 hours of the previous incident.
Police stopped the rider and immediately arrested him. Police subjected the rider to an oral fluid drug test which returned a positive result to methamphetamines.
Police conveyed the rider to Broken Hill police station where he was charged with:
* Drive motor vehicle during disqualification period – 2nd+ offence;
* Use unregistered vehicle on road;
* Use uninsured motor vehicle on road;
* Motor bike rider (alone) not wear/secure fit approved helmet;
* Fail or refuse to comply with prohibition or requirement;
* Possession of equipment for administering prohibited drugs.
The rider was bail refused by police to appear before Bail Division Court 4 on Saturday 10th January 2026. The rider was bail refused by the court until Tuesday 20th January 2026 to next appear before Broken Hill Local Court.
Police seized the e-scooter and an application has been made to the court for its forfeiture to the Crown.
